Did the Malfoy’s deserve safe harbor after the battle of Hogwarts?

After recently rereading the deathly hallows, this part stuck out to me that, after the battle of Hogwarts, the Malfoy‘s and Voldemort‘s defeat, the Malfoy’s lingered, and no one was paying them any attention. But to me, especially Lucius deserve to be rounded up and sent back to Azkaban. For one he had recently escaped, and was giving Aid to Voldemort right up until the end, including providing a headquarters for him. Also, at Malfoy manor, he was eager to turn Harry over over to you Voldemort, and was about to summon the dark Lord. In order of the Phoenix, he commands his forces to kill Harry’s friends if necessary. For Draco’s part in the previous year, he allowed the death eaters into Hogwarts, which resulted in Dumbledore’s murder and gray back injuring Bill. Not to mention the two assassination attempts that resulted in Katie being seriously injured, and Ronit was being poisoned to death. For these reasons, if I was hairy or anyone else, I would not allowed anyone any of them, especially Lucius Malfoy to linger I would’ve seen them sent back to Azkaban. Just because they didn’t fight or harm anyone in the battle of Hogwarts doesn’t really mean anything to me. Thoughts?
